Conciliation
1) A consumer who claims that an economic operator is violating a provision of this Act or the statutory instrument to be issued pursuant to Section 3 Paragraph 2 and who therefore cannot use the product or service in question, or can only use it to a limited extent, is entitled to submit an application for the initiation of conciliation proceedings to the Conciliation Board pursuant to Section 16 Paragraph 1 of the Disability Equality Act.

The Conciliation Board shall, at the consumer's request, involve the market surveillance authority as a party to the conciliation proceedings. 3 For the purpose of conducting the conciliation proceedings, it shall send a copy of the conciliation application to the economic operator and the market surveillance authority.
2) In addition, an application for the initiation of conciliation proceedings for the out-of-court settlement of a dispute arising from a consumer contract or concerning the existence of such a contractual relationship may also be submitted to the conciliation board pursuant to paragraph 1.
3) Paragraph 1 shall apply mutatis mutandis to an association recognized pursuant to Section 15 paragraph 3 of the Disability Equality Act or a qualified institution within the meaning of Section 3 paragraph 1, sentence 1, number 1 of the Injunctions Act that asserts that a provision of this Act or a provision of the legal regulation to be issued pursuant to Section 3 paragraph 2 has been violated and that the violation affects the respective statutory scope of duties of the association or qualified institution.
4) Proceedings pursuant to Section 32 paragraphs 1 or 2 shall be suspended until the conciliation proceedings have been concluded.
5) Furthermore, Section 16 Paragraphs 4 to 7 of the Disability Equality Act and the Disability Equality Arbitration Ordinance of November 25, 2016 (Federal Law Gazette I, p. 2659), as amended by Article 2 of the Ordinance of May 21, 2019 (Federal Law Gazette I, p. 738), apply.
