General terms and conditions

1. General
1.1 Scope of Application
These General Terms and Conditions apply in the version valid at the time of conclusion of the contract to all business relationships between us, Hamburg VKL Invest GmbH, Simon-von-Utrecht-Str. 33, 20359 Hamburg, and you. Any conflicting General Terms and Conditions are hereby expressly rejected.


1.2 Contractual Agreement
The contract language is German.


1.3 Conclusion of Contract
1.3.1 Via the Website
When placing an order via this website, the booking process consists of a total of two steps. In the first step, you select the desired date for your stay and can specify the number of people. In the second step, you will be redirected to our booking website www.cbooking.de, where you can specify your trip (e.g., select a specific offer, specify a room category, book extras, and note any requests).

Here you must also enter your personal information and credit card details for the booking before confirming your order by clicking the "Yes, book with payment" button. By placing your order, you are making a binding contractual offer. We will confirm receipt of the order immediately. Confirmation of receipt does not constitute a binding acceptance of the order. We are entitled to accept the contractual offer contained in the order within five calendar days of receipt of the order by email, fax, telephone, or mail. Acceptance constitutes the contract. The contract text will be stored by us and sent to you in text form (e.g., by email, fax, or mail) after you have submitted your order, along with these General Terms and Conditions and customer information. However, you will no longer be able to access the contract text via the website after you have submitted your order. You can print out the relevant website containing the contract text using the browser's print function.


1.3.2 Individual Contract
ConclusionThe contract can also be concluded individually through an offer and acceptance (e.g., by email). Unless otherwise agreed, the usual procedure is that you submit an inquiry and receive a binding offer from us, which you can then accept within two weeks. The contract is concluded upon acceptance. We do not store the contract text separately; instead, the contract content arises individually from the agreement reached.


2. Description of Services
2.1 Room Availability
Booked rooms will be made available to you from 3:00 PM. Earlier availability can be agreed upon. Unless otherwise agreed, you are not entitled to a specific room in our hotel. On the day of departure, the provided rooms must be vacated by 12:00 PM at the latest, made available to us again, and the key returned. In the event of a late return, we will claim any damages incurred by us:

  • Use of the room until 6:00 PM: 50% of the full room rate (list price)
  • Use after 6:00 PM: 100% of the full room rate (list price)

You retain the option of proving that we have suffered no or lesser damages.


2.2 Provision of Services
We are entitled to have the contract or parts of it fulfilled by third parties.

2.3 Time of Service
Unless expressly agreed otherwise, we will provide the service at the agreed time.


2.4 Changes and Extensions
Unless otherwise agreed or booked, changes and extensions will only be implemented if they are necessary to achieve the purpose of the contract. However, upon express customer request, changes and extensions can be implemented through our separate commission (e.g., booking an additional room, extending the length of stay). This will be charged separately.


2.5 Provision of Subjects for Filming or Photo Shooting
Filming or photo shootings for purposes other than exclusively private, commercial recordings, or recordings for public performance or broadcast require our approval and are charged separately.


3. Payment
3.1 Prices All prices include VAT.
You must provide your credit card details for the booking so that we can verify their validity.
If you do not have a credit card, we reserve the right to request an advance payment of 90% of the agreed total amount. The payment deadline can be found on the invoice. In the event of late or non-payment, we will attempt to reassign the booked rooms. If the booked room or space can no longer be allocated, we will invoice you 90% of the total amount.


3.2 Default of Payment
You will be in default of payment if payment is not received within two weeks of receipt of the invoice, unless a shorter payment period has been agreed upon. In the event of default of payment, interest will be charged at a rate of 5 percentage points above the base interest rate of the European Central Bank, or 9 percentage points above the base interest rate of the European Central Bank for legal transactions in which a consumer is not involved. Should you default on your payments, we reserve the right to charge reminder fees of €2.50. The right to claim additional damages remains unaffected. You retain the option of proving that we have suffered no or lesser damages.

In the event of default of payment, we reserve the right to suspend our services until you have fulfilled your payment obligation.


3.3 Right of Retention
You are only entitled to assert a right of retention for counterclaims that are due and based on the same legal relationship as your obligation.


3.4 Cancellations of Hotel Rooms
Reserved rooms will be held free even after 6:00 PM. In the event of a no-show, 90% of the total amount will be charged unless we are able to reassign the rooms.
The following applies to cancellations:

  • Individual reservations (1-2 hotel rooms)
    Rooms can be canceled free of charge up to 24 hours before arrival.
  • Group reservations (3 or more hotel rooms)
    Reserved rooms can be canceled free of charge up to 30 days before the group's arrival.

Long-stay reservations (minimum 7 nights)Rooms can be canceled free of charge up to 30 days before arrival.


After this deadline, we will charge you 90% of the total amount.


During public holidays and trade fair periods, individual reservations can be canceled free of charge up to 3 days before arrival, notwithstanding the aforementioned regulations. Group reservations can be canceled free of charge up to 45 days before arrival. After this deadline, we will also charge you 90% of the total amount.

You reserve the right to provide evidence that we have incurred no or lower costs.


3.5 Cancellations of Conferences and Events (Reduction in the Number of Participants)
For conferences/events, we will charge you 90% of the total amount if the space is not used, unless we are able to allocate the space to someone else.

You can cancel the conference/event free of charge or reduce the number of participants up to 30 days before the start of the event.

You reserve the right to provide evidence that we have incurred no or lower costs.
For events with 10 or more people where food and/or beverages are served, the organizer must provide us with the menu selection no later than 21 working days before the start of the event. If this information is provided to us late, the desired food or beverages may no longer be available.


4. Right of Withdrawal
The right of withdrawal does not apply to distance selling contracts for the provision of services in the areas of accommodation for purposes other than residential use, the transport of goods, motor vehicle rental, the delivery of food and beverages, and the provision of other services related to leisure activities, if the contract stipulates a specific date or period for their provision.


5. Your Responsibility
5.1 General
You are solely responsible for the content and accuracy of the data you provide when booking.


5.2 Inability to attend
If you are unable to attend on the day of arrival (e.g., due to illness), you may, after prior notification, appoint a replacement guest. However, cancellation is not possible.


5.3 Items
Items that are our property or the property of third parties and that are made available to you under the contract (e.g., room furnishings) must be treated with care at all times.


5.4 Smoking Ban
The smoking ban in force in the hotel area must be observed at all times. We reserve the right, in particular, to assert a claim for damages in the event of a violation of the smoking ban, which arises because the room affected by smoking cannot be re-let immediately afterward due to the increased cleaning effort. You retain the right to prove that the damage claimed for this reason did not occur, or did not occur to the amount claimed.


5.5 Behavior
The consumption of drugs is not permitted during your stay in our hotel. The consumption of alcohol is only permitted in limited quantities. If we notice that you are exhibiting symptoms of impairment or similar and are therefore endanger the well-being of other guests and us (e.g., through aggressive behavior), we reserve the right to expel you from our hotel. Fees already paid cannot be refunded in these cases.


5.6 Subletting or Reletting
The subletting or reletting of the rooms and spaces provided, as well as their use for purposes other than accommodation and event purposes, requires our prior consent.


6. Liability
6.1 Exclusion of Liability
We, our legal representatives, and vicarious agents are only liable for intent or gross negligence. To the extent that essential contractual obligations (i.e., obligations whose compliance is of particular importance for achieving the purpose of the contract) are affected, liability is also assumed for slight negligence.In this case, liability is limited to foreseeable, contract-typical damages. In the event of a grossly negligent breach of non-essential contractual obligations, we are only liable to businesses up to the amount of foreseeable, contract-typical damages.


6.2 Reservation of Liability
The above exclusion of liability does not apply to liability for damages resulting from injury to life, limb, or health. The provisions of the Product Liability Act remain unaffected by this exclusion of liability.


6.3 Theft
You are responsible for securing your belongings against theft and properly storing them. We merely provide you with our premises or safe, but assume no liability for theft.

6.4 Parking Space
If a parking space is provided to you in our hotel garage or parking lot, even for a fee, this does not constitute a safekeeping contract. We are not liable for the loss of or damage to motor vehicles parked or maneuvered on the hotel property and their contents, unless we are at fault. The other liability provisions remain unaffected.


6.5 Wake-up calls and shipments
Wake-up calls are carried out by us with the utmost care, but are not part of the booked service and are to be considered a free additional service. You are responsible for ensuring that you meet your deadlines.Messages, mail, and shipments will also be handled with the utmost care for you. We will undertake delivery, storage, and – upon request – forwarding of such shipments for a fee.
We are not liable for delays that are not our fault and for which we are not responsible. The remaining liability provisions remain unaffected.


7. Final Provisions
7.1 Place of Jurisdiction
Our registered office shall be the exclusive place of jurisdiction for all legal disputes arising from this contract, provided you are a merchant, a legal entity under public law, or a special fund under public law, or provided you have no place of jurisdiction in the Federal Republic of Germany.


7.2 Choice of Law
Unless mandatory statutory provisions under your home country conflict with this, German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.


7.3 Consumer Dispute Resolution Procedure
The EU Commission has created an internet platform for the online resolution of disputes concerning contractual obligations arising from online contracts (ODR platform). You can access the ODR platform at the following link: http://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.


7.4 Severability Clause
The invalidity of individual provisions does not affect the validity of the remaining General Terms and Conditions.
